ASIC Expands CFD Investor Protection to Crypto Asset Derivatives
The Australian Securities and Investments Commission (ASIC) plans to expand its Contracts for Difference (CFD) rules to include derivatives that settle in digital assets and meet other conditions. Relevant products will be subject to leverage limits, mandatory closeouts, and negative balance protection, except for certain cryptocurrency futures and options with fixed expiration dates. ASIC is seeking industry and stakeholder feedback on the proposed amendments, with a deadline of November 9. The current CFD regulatory framework was introduced in 2021, requiring service providers to close positions when account funds fall below a certain level, and limiting client losses to the amount in their CFD accounts through negative balance protection. Australia passed legislation in April to include cryptocurrency exchanges and tokenized custody platforms within the financial services licensing framework, with the new system set to take effect on April 9, 2027.
